Theima (“we”, “us”) is operated from Australia. These terms govern your use of the Theima service.
1. Acceptance of terms
By creating a Theima account you agree to these terms. If you do not agree, do not use the service. These terms may be updated from time to time — continued use after changes constitutes acceptance.
2. Data accuracy disclaimer
Theima provides venue, radio station, and contact information sourced from community contributions and public sources. We do not guarantee the accuracy, completeness, or currency of this information. Contact details can become stale. Always verify contact information before relying on it for professional communications. Theima accepts no liability for decisions made based on information in the platform.
3. User-contributed content
When you submit data to Theima (venue suggestions, contact updates, reviews), you grant Theima a non-exclusive, royalty-free licence to use, store, display, and distribute that content as part of the platform. You represent that you have the right to contribute the data and that it is accurate to the best of your knowledge.
When the data you contribute includes another person’s or organisation’s contact details, you confirm that you have a legitimate basis for sharing it with Theima (for example, it is publicly listed business contact information, or a professional contact you deal with directly). You must not upload private or personal contact information — such as a personal mobile number or private email address — that is not intended for professional contact, and you must not contribute contact data obtained in breach of any obligation of confidence or any law.
4. Subscriptions and billing
Theima Pro subscriptions are billed monthly or annually via Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods. The founding rate, where offered, is locked for the life of a continuous subscription and is forfeited on cancellation.
5. Acceptable use
You may not use Theima to send spam, to harvest contact information for purposes other than legitimate artist outreach, or to submit false or misleading data. We reserve the right to suspend accounts that violate these terms.
Emails you send through Theima are sent from your own connected email account, and you are responsible for them. You must ensure your outreach complies with applicable laws, including anti-spam law such as the Australian Spam Act 2003 — for example, identifying yourself accurately and honouring any request from a recipient to stop contacting them.
6. Limitation of liability
Theima is provided “as is.” To the maximum extent permitted by law, we exclude all warranties and limit our liability to the amount you paid for the service in the 12 months preceding any claim.
7. Governing law
These terms are governed by the laws of Victoria, Australia. Disputes will be resolved in the courts of Victoria.
